Abstract

The present paper is aimed at conducting a theoretical study on copyright and on its relation to digital preservation by analyzing the copyright Law 9.610 in Brazil. One of the important aspects of digital preservation is copyright and its relation with the laws that govern it. In Brazil, the law that currently governs the copyright is the Law 9.160 from February 19th, 1998. Since any preservation strategy implies reproducing the digital object, to be considered as legal, the act of digital preservation must be based on the authorization of the copyright holder and on the existing legislation. By analyzing the law, it is possible to observe the need of revising it, mainly on issues related to the digital preservation and the availability of such information.

José Carlos Abbud Grácio, UNESP Campus de Marília

José Carlos Abbud Grácio ha graduación en Ciencias de la Computación (1987) por la Universidad Estadual de Campinas - UNICAMP y la maestría en Ciencias de la Información (2002) por la Universidad Estadual Paulista (UNESP). Desde 2007, es estudiante de doctorado en Ciencias de la Información en la UNESP. Tiene experiencia en Informática y Ciencias de la Información y fue Director de Informática en la UNESP de Marília, en el período de 1995 a 2009. Ha publicado 9 trabajos en anales de eventos científicos y ha participado en 9 eventos científicos nacionales e internacionales. Actualmente, ha dirigido sus investigaciones y estudios en el ámbito de la preservación digital.
